Terms of Service

1. The Service

Balbi Games LLC provides NarutoSim.com, a collection of fan-made tools for the Naruto Card Game (the “Service”). Depending on which features are available, the Service may include a card gallery, deck building and sharing, profiles, collections, events, memberships, and an online card game simulator with private rooms, matchmaking, spectating, chat, match history, and replays.

This is an unofficial fan project. Naruto and all related names, characters, artwork, and trademarks belong to their respective rights holders. No affiliation or endorsement is implied.

The simulator, card data, deck legality results, rulings, and other game information are unofficial community tools. They are not authoritative tournament rulings and may differ from official products, rules, or decisions.

2. Eligibility and accounts

You must be at least 13 to create an account or use interactive features. If you are not old enough to enter a binding agreement where you live, your parent or legal guardian must review and agree to these Terms for you. You represent that you meet these requirements and are not barred from using the Service under applicable law.

You must provide accurate account information, keep access to your email and third-party sign-in accounts secure, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account. Accounts are personal and may not be sold, licensed, or transferred without our permission.

3. Acceptable use and fair play

You may use the Service only lawfully and in accordance with these Terms. You may not:

• harass, threaten, impersonate, exploit, or harm another person;
• post unlawful, infringing, deceptive, hateful, sexually explicit, or malicious content;
• cheat, collude, manipulate matches, ratings, statistics, or matchmaking, or exploit bugs for an unfair advantage;
• evade moderation, suspensions, bans, safety controls, or account restrictions;
• probe, scan, disrupt, overload, or bypass security, access controls, rate limits, or technical restrictions;
• use bots, scrapers, or automated means that burden the Service or collect personal information, except with our written permission or as allowed by law;
• reverse engineer or attempt to extract source code except where that restriction is prohibited by law;
• upload malware or use the Service to send spam or unauthorized advertising; or
• use the Service, another user’s content, or Service data to violate law or another person’s rights.

4. Simulator and community interactions

Simulator matches may involve other users and may be affected by network delays, software defects, card or rules errors, disconnects, or moderation actions. We do not guarantee a particular opponent, match result, ranking, rules interpretation, or uninterrupted match. Do not use the Service for gambling, wagering, or unauthorized prize competitions.

When simulator features are enabled, game actions, match state, room participation, results, reports, and eligible replays may be recorded to operate the match, resolve disputes, enforce fair-play rules, and provide history or replay features. Chat and other communications may be reviewed or preserved for safety and moderation. Other users may see information you make available in a room, match, profile, deck, chat, replay, or spectator view.

Use reporting and blocking controls when available, and contact us about urgent safety concerns. We may investigate reports and take action, but we do not promise to monitor every interaction or resolve every dispute.

5. User content

You retain ownership of original content you submit, such as deck names, deck guides, profile text, chat messages, and uploaded media (“User Content”). You grant Balbi Games LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, moderate, and otherwise use User Content as needed to operate, secure, improve, and promote the Service according to your visibility choices. For public User Content, this license allows us to make it available to others and create previews or links.

This license ends when the content is deleted, except for reasonable backup periods, deidentified material, records retained for safety or legal reasons, and copies others made while it was available. You represent that you have the rights needed to submit User Content and that it complies with these Terms. Public content can be copied or reshared by others.

We may remove, restrict, preserve, or disclose User Content when reasonably necessary to operate the Service, enforce these Terms, protect users, investigate abuse, or comply with law.

6. Our rights and third-party materials

Except for User Content and third-party game materials, the Service, including its original software, design, text, branding, and arrangement, is owned by Balbi Games LLC or its licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, noncommercial purposes.

References to third-party products and services do not imply endorsement. If you believe content on the Service infringes your rights, email contact@narutosim.com with identification of the work, the material and its location, your contact information, a good-faith statement, and any other information required by applicable law.

7. Third-party services

The Service relies on or links to third-party services, which may include Supabase for authentication and data storage, Cloudflare for hosting and multiplayer infrastructure, Stripe for subscription billing, and Google or Discord for sign-in and community features. Their own terms and privacy policies may apply to your direct use of them. We are not responsible for third-party services that we do not control. You are responsible for carrier, internet, and device charges.

8. Supporter subscriptions, VIP access, and billing

When offered, Supporter memberships are recurring monthly or annual subscriptions. The price, billing period, benefits, and applicable taxes will be shown before checkout. By subscribing, you authorize Stripe, our payment processor, to charge your selected payment method when the subscription begins and at each renewal until you cancel. A subscription automatically renews for the same billing period unless it is canceled.

You may manage or cancel a subscription through the billing portal linked from your account. Cancellation takes effect at the end of the current paid billing period, and Supporter access continues until then. Except where required by law or expressly stated otherwise, payments are nonrefundable and we do not provide credits for partial billing periods. Failed, reversed, or overdue payments may suspend benefits.

We may change membership benefits, limits, storage allowances, and retention periods prospectively as the Service evolves. We will provide any notice or consent required by law before materially changing the price of an existing subscription. Site features remain available without a subscription. If membership ends, standard match-history and replay retention limits apply after any disclosed grace period.

VIP is a complimentary role that provides Supporter recognition and retention benefits without recurring charges while the role remains assigned. VIP status is not a purchased subscription, stored value, property right, or transferable benefit. We may assign or remove VIP status consistently with program eligibility, safety, enforcement, or operational decisions.

9. Changes and availability

The Service may include new or limited-availability features. We may add, change, suspend, or discontinue features, impose reasonable limits, or correct data without liability, subject to applicable law. We do not promise uninterrupted availability, permanent storage, compatibility with every device, or that community-created content and the unofficial simulator are complete or error-free. Keep copies of content you cannot afford to lose.

10. Suspension and termination

You may stop using the Service at any time, cancel a paid subscription through the billing portal, and request account deletion as described in the Privacy Policy. We may suspend or terminate access, remove content, invalidate match results, or restrict features if we reasonably believe you violated these Terms, created risk or legal exposure, or if action is needed to protect the Service or other users. Where appropriate, we will give notice and an opportunity to appeal by contacting us.

Provisions that by their nature should survive termination, including ownership, licenses needed for retained public or deidentified content, billing obligations, disclaimers, liability limits, indemnity, and dispute terms, will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BALBI GAMES LLC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE, CARD DATA, DECK VALIDATION, SIMULATOR, MATCHMAKING, OR SUBSCRIPTION FEATURES WILL BE ACCURATE, SECURE, UNINTERRUPTED, OR ERROR-FREE.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALBI GAMES LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, SUBSCRIPTION BENEFITS, MATCH RESULTS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply to liability that cannot be limited by law, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of mandatory consumer rights. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Balbi Games LLC and its members, officers, employees, and contractors from third-party claims, damages, losses, and reasonable costs arising from your User Content, your unlawful use of the Service, or your material violation of these Terms. This obligation does not apply to the extent a claim results from our own conduct, and it does not limit rights that cannot be waived under applicable consumer law.

14. Governing law and disputes

Before filing a formal claim, you and Balbi Games LLC agree to try in good faith for 30 days to resolve the dispute by emailing a written description to contact@narutosim.com. These Terms are governed by the laws applicable to Balbi Games LLC where it is organized and operates, without regard to conflict-of-law rules. Claims may be brought in a court of competent jurisdiction. If you are a consumer, this section does not deprive you of mandatory protections or a forum available under the law where you live.

15. General terms

These Terms and the documents they incorporate are the entire agreement about the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service. No third party is a beneficiary unless these Terms expressly say otherwise.

16. Changes to these Terms

We may update these Terms to reflect changes to the Service, subscriptions, simulator functionality, law, or risk. We will post the revised Terms with a new effective date and, when required, provide additional notice or request renewed agreement. Changes apply prospectively. Continuing to use the Service after the effective date of properly noticed changes constitutes acceptance where permitted by law.
